Can I smoke on the stairs of a multi -storey residential building? Similar questions are asked not only by smokers, but also by neighbors who oppose smoking. The Citizens' Health Protection Act, which bans smoking tobacco products in all public places, has undergone several changes.
According to the amendment, smokers are prohibited from smoking in multi -storey buildings.
The main provisions of the anti-tobacco law
Is it possible to smoke cigarettes at the entrances and elevators of residential buildings? The law, which imposes a ban on smoking in public places, aims to protect the rights of non-smokers. Tobacco smoke from cigarettes has a negative impact on the health of people who are not addicted to nicotine.
On what grounds was a law prohibiting the use of cigarettes in congested areas adopted?
The impetus to take anti-tobacco action at the state level is a horrible statistic:
- More than 40% of people suffer from nicotine addiction;
- About 400 thousand citizens die each year from cancer and other smoking-related diseases;

In connection with the above reasons, the Ministry of Health proposes to draft a law banning smoking, at least in the area where citizens meet spontaneously:

- playgrounds and sports venues;
- cafes and hotels;
- airports and railway stations;
- aprons and parking spaces;
- government agencies and hospitals;
- air and land transport;
- trade and household companies;
- work areas and transportation stops;
- seaports and railways.
Clearly, for heavy smokers, the list of prohibited places that are suitable to meet nicotine requirements is quite extensive. Therefore, from time to time they still break the law and commit illegal acts, for which they then bear administrative responsibility.
Is it possible to smoke at the entrance of a residential building?
According to the new law on the ban on smoking in public places, you cannot use cigarettes at the entrance. The entrance of the residential building was closed for smoking due to lack of ventilation system. For this reason, the use of tobacco products on stairs and ladders is prohibited.
To protect the health of citizens who are not addicted to nicotine, the anti-tobacco project specifies the following places in apartment buildings where smoking is strictly prohibited:
- elevators and basements;
- stairs and attics;
- technical rooms and corridors.
Failure to comply with the instructions, the smoker will be punished in the form of punishment.
To bring a violator to justice, you need to write an appropriate statement to the police.
Exceptions to the rule
Fines for smoking at the entrance are not imposed in all circumstances.
Although there are points stated in the anti-tobacco law, smoking at the entrance of high-rise buildings is still possible, but only if certain conditions are met:
- the presence of special places for smoking;
- the presence of a ventilation system in the "smoking room";
- compliance of smoking areas with fire safety standards;
- consent of tenants of high -rise household buildings for "smoking room" equipment at the entrance.
In all other cases, the smoker is responsible for smoking at the entrance. If the offender is guilty, he will be fined.
Fines for smoking at the entrance
What punishment can be imposed by an offender for smoking a cigarette at the entrance of a multi -storey residential building?
The law is quite strict and therefore provides for very heavy penalties for heavy smokers because:
- use of cigarettes on the stairs.
- smoking near the playground.
- involvement of minors in the smoking process.
In addition, fines are also imposed on officials who are obliged to monitor the implementation of the adopted law.
The protection of public order is entirely the responsibility of the police, and fines are imposed by its employees if these individuals violate laws on smoking bans and tobacco distribution.
How to punish offenders?

If the person is unsure of your request to discard the cigarette, you need to do the following:
- recording the offender’s smoking process in the wrong place on a video camera or cameras;
- write statements to law enforcement agencies and provide video and photographic materials confirming the veracity of testimony;
- provide at least two witnesses who can verify the truth of your words and the authenticity of the photo and video material.
These measures will be enough to punish negligent neighbors for not complying with the rules set out in the anti-tobacco law.
